Terms of service

Effective date: 01/08/2026

1. Introduction

Welcome to Himcognito (“Himcognito”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your use of our website, online store, and any related services, content, features, products, and customer support services we provide (collectively, the “Services”).

By accessing our website, browsing our products, or placing an order with us, you agree to be bound by these Terms together with our Privacy Policy, Refund Policy, and any other policies referred to within these Terms. If you do not agree with these Terms, you should not use our Services.

Nothing in these Terms affects your statutory rights under UK consumer law.

2. About Us

Himcognito is a UK-based online retailer. Our website and online store are hosted by Shopify, which provides the e-commerce platform that enables us to sell our products and services to you.

For the purposes of these Terms, the contract for the sale of goods is between you and Himcognito, not Shopify.

If you need to contact us, you can do so at:

Email: hello@himcognito.com

3. Eligibility and Use of Our Services

To purchase products from our website, you must:

  • be at least 18 years old; or
  • have the legal capacity to enter into a binding contract under the laws of your country of residence.

You agree that any information you provide to us, including your name, billing address, delivery address, payment details, and contact information, is accurate, complete, and up to date.

You are responsible for maintaining the confidentiality of any account credentials associated with our Services and for all activities carried out through your account.

You must not use our Services for any unlawful, fraudulent, or unauthorised purpose.

4. Our Products

We make every effort to display our products as accurately as possible, including colours, dimensions, and descriptions. However, the appearance of products may vary depending on your device, screen settings, and lighting conditions.

Product descriptions, specifications, availability, and pricing may be updated from time to time without prior notice.

All products are subject to availability. We reserve the right to discontinue any product or limit the quantity of products available for purchase.

5. Placing an Order

When you place an order through our website, you are making an offer to purchase the selected products.

After you submit your order, you will receive an email acknowledging that we have received it. This acknowledgement does not constitute acceptance of your order.

A contract between you and Himcognito is formed only when we send you an email confirming that your order has been accepted and dispatched.

We reserve the right to refuse or cancel an order before dispatch for reasons including, but not limited to:

  • product unavailability;
  • pricing or product description errors;
  • suspected fraud or unauthorised transactions;
  • orders that appear to be placed for commercial resale;
  • inability to verify payment or customer information.

If we cancel your order after payment has been taken, we will provide a full refund using the original payment method.

6. Prices and Payment

All prices displayed on our website are in Pounds Sterling (£).

Unless otherwise stated, prices include UK VAT where applicable.

Delivery charges are shown separately during the checkout process and are included in the total price before you complete your purchase.

We accept payment using the payment methods displayed at checkout. Payment must be authorised before your order is accepted.

We take reasonable care to ensure that prices are accurate. However, if a pricing error is discovered, we are not obliged to supply goods at the incorrect price. We will contact you to confirm whether you wish to proceed at the correct price or receive a full refund.

7. Promotions and Discount Codes

From time to time we may offer promotional discounts, voucher codes, or special offers.

Unless otherwise stated:

  • only one discount code may be used per order;
  • discount codes cannot be exchanged for cash;
  • discount codes may not be applied retrospectively to completed orders;
  • we reserve the right to withdraw or amend promotions at any time.

Promotional offers are subject to any additional terms and conditions stated with the offer.

8. Delivery

We deliver to the destinations listed on our website.

Estimated delivery times are provided for guidance only and are not guaranteed. Delays may occur due to factors outside our reasonable control, including courier delays, customs procedures, severe weather, or other unforeseen events.

Risk in the goods passes to you when the goods are delivered to you or to a person identified by you to take possession of the goods.

Ownership of the goods passes to you once we have received payment in full for the goods and any applicable delivery charges.

If delivery cannot be completed because incorrect information was provided, additional delivery charges may apply for re-delivery.

9. Your Right to Cancel

If you are purchasing as a consumer in the United Kingdom, you have the right to cancel your order in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You generally have 14 days from the day you receive the goods to notify us that you wish to cancel your order for any reason.

You then have a further 14 days to return the goods to us.

Our Refund Policy provides additional information about returns, exchanges, and refunds.

Certain items may not be eligible for cancellation where an exception applies under the Regulations, including sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed.

10. Faulty, Damaged or Incorrect Goods

If goods are faulty, damaged, or not as described, you may be entitled to a repair, replacement, refund, or other remedy under the Consumer Rights Act 2015.

You should contact us as soon as reasonably possible after discovering the issue.

Nothing in these Terms limits or excludes your statutory rights in relation to faulty or misdescribed goods.

11. Intellectual Property

All content available on this website, including but not limited to text, images, photographs, graphics, logos, branding, product descriptions, videos, artwork, website design, software and other materials, is owned by or licensed to Himcognito and is protected by UK and international intellectual property laws.

You may access and use this website solely for your own personal, non-commercial use.

You must not, without our prior written permission:

  • reproduce, copy or republish any content from this website;
  • modify or create derivative works from our content;
  • distribute or commercially exploit any material from the website;
  • use our trade marks, logos or branding in any way that suggests endorsement or association with Himcognito.

Nothing in these Terms grants you any ownership or licence in relation to our intellectual property except as expressly stated.

12. Promotions, Offers and Discount Codes

From time to time, we may offer promotional discounts, voucher codes or special offers.

Unless otherwise stated:

  • only one promotional code may be used per order;
  • discount codes cannot be exchanged for cash;
  • codes cannot be applied retrospectively after an order has been placed;
  • offers may be withdrawn or amended at any time without prior notice.

Where separate promotional terms apply, those terms will take precedence over these Terms in the event of any inconsistency.

We reserve the right to cancel any promotion where we reasonably believe it has been misused or where a technical error has resulted in an incorrect discount being applied.

13. Customer Reviews and User Content

We welcome honest reviews and feedback from our customers.

If you submit reviews, photographs, comments or other content ("User Content") through our website or social media channels, you confirm that:

  • the content is your own or that you have permission to share it;
  • it does not infringe the rights of any third party;
  • it is not defamatory, abusive, offensive, unlawful or misleading.

By submitting User Content, you grant Himcognito a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish and display that content for marketing, promotional and customer service purposes.

If you would prefer us not to use your content in this way, please contact us and we will consider your request promptly.

We reserve the right to remove User Content that we reasonably believe breaches these Terms or is otherwise inappropriate.

14. Acceptable Use

You agree not to use our website:

  • for any unlawful purpose;
  • to commit fraud or facilitate fraudulent activity;
  • to introduce viruses, malware or malicious code;
  • to interfere with the operation or security of the website;
  • to attempt unauthorised access to our systems;
  • to harvest customer information or personal data;
  • to copy, scrape or exploit website content without permission.

We may suspend or restrict access to our website where we reasonably believe these Terms have been breached or where necessary to protect our business, customers or systems.

15. Third-Party Websites and Services

Our website may contain links to websites or services operated by third parties.

These links are provided for your convenience only.

We have no control over third-party websites and accept no responsibility for their content, availability or privacy practices.

Your use of any third-party website is subject to that website's own terms and policies.

16. Privacy

We are committed to protecting your privacy and handling your personal information responsibly.

Our collection and use of personal information is governed by our Privacy Policy, which explains:

  • what information we collect;
  • how we use it;
  • who we share it with;
  • your rights under UK data protection legislation.

Our website is hosted on the Shopify platform. Shopify processes certain personal information on our behalf in order to provide the ecommerce services that enable us to operate our online store.

For more information, please refer to our Privacy Policy.

17. Website Availability

We aim to keep our website available at all times.

However, we cannot guarantee uninterrupted access and may occasionally suspend or restrict access for maintenance, upgrades or technical reasons.

We will not be liable where the website is unavailable due to events beyond our reasonable control.

18. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so.

This includes liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation;
  • breach of your statutory rights under applicable consumer legislation.

Subject to the above, we shall not be liable for:

  • losses that were not reasonably foreseeable;
  • indirect or consequential losses;
  • business losses suffered by consumers using our website for personal purposes.

Our total liability in relation to any order shall not exceed the total amount paid by you for the products concerned, except where the law requires otherwise.

19. Events Outside Our Reasonable Control

We shall not be responsible for delays or failure to perform our obligations where caused by circumstances beyond our reasonable control.

These may include, but are not limited to:

  • severe weather;
  • natural disasters;
  • industrial disputes;
  • transport disruption;
  • pandemics;
  • government action;
  • interruption to utilities or telecommunications;
  • cyber attacks affecting essential infrastructure.

Where such circumstances occur, we will make reasonable efforts to minimise any disruption and fulfil orders as soon as reasonably practicable.

20. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal obligations or the services we provide.

The latest version will always be published on our website together with the date it was last updated.

Changes will apply only to orders placed after the revised Terms take effect unless otherwise required by law.

21. Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining Terms.

The remaining provisions shall continue in full force and effect.

22. Waiver

If we delay or fail to exercise any right under these Terms, this shall not prevent us from exercising that right at a later date.

Any waiver must be made expressly in writing.

23. Governing Law and Jurisdiction

These Terms and any contract between you and Himcognito shall be governed by the laws of England and Wales.

If you are a consumer, you may also have the benefit of mandatory legal protections available under the laws of the part of the United Kingdom in which you live.

Any disputes arising in connection with these Terms shall be subject to the jurisdiction of the courts of England and Wales, except where applicable law provides otherwise.
